Bigdata PoC Deployment Service – Terms & Conditions

The Bigdata Deployment Service (the “Service”) is provided solely as a Proof of Concept (“PoC”) by RavenPack International SLU (“RavenPack”). This PoC is intended for illustrative and evaluation purposes only and does not constitute a commitment, guarantee, or warranty regarding future product performance, functionality, or availability. As an experimental version, the Service may contain bugs, errors, or incomplete features, and its design, features, and availability are subject to change or discontinuation at RavenPack’s sole discretion without prior notice. Use of the Service is governed by the terms and conditions set forth below.

1. Acceptance of Terms

By using the Service, you agree to comply with these Terms and Conditions. If you do not accept these Terms, you must not access or use the Service. These Terms govern your use of the Service, including any interaction with applications built on it and any data or results generated through the Service. By continuing to use the Service, you confirm that you understand the PoC nature of the Service, its limitations, and the confidentiality obligations described herein.

2. Purpose of the Service

The Service is provided exclusively for limited testing, demonstration, and evaluation of applications built on top of the Bigdata Research Tools library. It is experimental in nature, may be unstable, and its functionality or behavior may change, be interrupted, or be discontinued at any time without notice. The Service is not designed, intended, or warranted for production, operational, commercial, or decision-making use of any kind. Any outputs, data, or results generated through the Service are illustrative and indicative only, and shall not be considered accurate, reliable, or fit for any real-world application. Users acknowledge that reliance on the Service or its outputs for purposes beyond demonstration and evaluation is entirely at their own risk.

3. Licenses

Applications deployed via the Service are released under the MIT License and are freely available on GitHub. Users may use, modify, and distribute these applications according to the MIT License terms. The Service and its applications, however, are built on top of the Bigdata Research Tools library, which is not open-source and is released under a proprietary license. This library is hosted separately on GitHub at bigdata-research-tools and is governed by its own license terms. By using the Service, you acknowledge that you are responsible for complying with the license of Bigdata Research Tools and that any use beyond what is permitted by its license may expose you to liability.

4. API Key

To interact with the Bigdata API through the Service, you must have a valid BIGDATA API Key. The Service encrypts the API Key for security purposes and does not store it. Users are fully responsible for maintaining the confidentiality of their API Key and for any activity performed under it. RavenPack cannot be held liable for misuse, loss, or unauthorized use of the API Key.

5. Data and Results

All data, outputs, and results generated by the Service are provided solely for limited testing, evaluation, and demonstration purposes and are supplied strictly on an “as-is” and “as-available” basis. RavenPack makes no representations or warranties of any kind, express or implied, as to the accuracy, completeness, reliability, timeliness, merchantability, fitness for a particular purpose, or suitability of such data or results. Users acknowledge and agree that the Service’s outputs are experimental in nature and may contain errors, omissions, or inaccuracies. Any reliance on, or use of, the Service’s data, outputs, or results for operational, production, commercial, financial, or decision-making purposes is strictly at the sole risk of the user. RavenPack expressly disclaims all liability arising from or relating to such reliance or use, and under no circumstances shall any such outputs be deemed professional advice or guaranteed results.

6. Restrictions

The Service is provided strictly for PoC purposes and must not be used for production or commercial deployment. Users agree not to reverse-engineer, reproduce, or misuse the Service beyond its intended PoC functionality. Any attempt to bypass security measures or share credentials without authorization is prohibited. Users acknowledge that the Service may be modified, suspended, or terminated at any time without notice, and the provider shall not be responsible for any consequences resulting from such changes.

7. Privacy and Cookies

By using the Service, you acknowledge and accept that your use is governed by the Privacy Policy and Cookie Policy of Bigdata.com. You should review these policies carefully to understand how your information is collected, used, and protected. 8. Limitation of Liability

To the maximum extent permitted by applicable law, RavenPack, as the provider of the Service, disclaims all liability for any and all damages, losses, claims, costs, or expenses of any kind, whether direct, indirect, incidental, consequential, special, exemplary, or punitive, arising out of or in connection with the access to, use of, inability to use, reliance on, or performance of the Service or any data, content, or output generated thereby. The Service is provided solely on an “as-is” and “as-available” basis for evaluation and proof-of-concept purposes, without any warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement. Users assume all risks associated with the use of the Service, and RavenPack shall not be responsible or liable for any decisions, actions, or outcomes resulting from such use, even if advised of the possibility of such damages. In all cases, RavenPack’s aggregate liability, if any, shall be limited to zero.

9. Termination

RavenPack reserves the unrestricted right, at its sole discretion, to suspend, restrict, or terminate access to the Service, in whole or in part, at any time and for any reason, with or without notice. Users acknowledge and agree that the Service may be modified, interrupted, suspended, or permanently discontinued at any time, and that RavenPack shall have no obligation to provide continued access, support, maintenance, updates, or replacement services. RavenPack shall not be liable for, and expressly disclaims, any and all damages, losses, costs, claims, or inconveniences of any kind arising from or related to suspension, restriction, modification, or termination of the Service.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes arising out of or in connection with the Service or these Terms shall be resolved under these laws.

11. Changes to Terms

The provider may revise or update these Terms at any time. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
